My experience with timeshare law began in 2012 while I was with a law firm in Orlando, Florida. I received a call from a timeshare owner who simply wanted out of her timeshare ownership, but had no luck discussing the matter with the timeshare company. I negotiated with the resort’s legal team and was able to secure the cancellation within a few months.

After helping hundreds of timeshare owners, I moved to Idaho and became a full-time business professor in 2017. Due to my past experience and publications on the subject, however, I still receive requests to help individuals around the world with their timeshares. As a result, I make time to assist clients with timeshare-related requests.

The need for my services has only grown as novel and pernicious timeshare scams proliferated. These include non-attorney exit companies, fraudulent sales groups, and transfer groups that demand high upfront fees, scamming timeshare owners out of millions of dollars each year.

Timeshare Cancellation or Timeshare Exit

The bulk of my clients since 2012 have simply sought to cancel their timeshare ownership. The reasons they give include:

  1. Fraud or misrepresentation during the timeshare sales process

  2. Financial hardship due to medical complications or job loss,

  3. Inability or difficulty traveling due to age, and

  4. Extreme pressure to upgrade or otherwise enhance existing timeshare ownership.

Timeshare Scams

A growing number of clients have been scammed by groups offering to purchase timeshare for inflated prices. The process following a similar scheme:

  1. Timeshare owners receive an unsolicited offer to purchase their timeshare.

  2. The purchase offer is often in excess of what the owners paid to purchase the timeshare.

  3. After signing a purchase agreement, the buyer demands that they timeshare owner wire funds, often under the guise of a purported tax

  4. If the timeshare owner wires these funds, the buyer will demand more and more money, always promising that after the next transaction, the purchase will proceed.

  5. The timeshare owner is often threatened with legal action if they do not wire additional funds.

  6. The buyer, broker, or other assisting company has a website that was recently filed, the company is not registered with the state’s secretary of state, or it simply impersonates a legitimate business.
